Can a landlord evict a tenant without proper notice?
Under the RTA, a landlord cannot legally evict a tenant without following the proper process, which includes serving an approved notice form from the LTB (e.g., N4 for non-payment of rent, N12 for landlord’s own use, etc.). The notice must specify the reason for eviction and provide the required notice period (e.g., 14 days for non-payment of rent, 60 days for landlord’s own use).
As of November 2024, LTB processing times are longer than 4–12 weeks for most cases. According to Tribunals Ontario, landlord applications for non-payment of rent (L1) or rent arrears (L9) are scheduled within approximately 3 months (12 weeks) from filing, while other application types (e.g., L2 for other reasons) take 5–7 months (20–28 weeks). Urgent matters, like illegal lockouts, may be scheduled in 5–6 weeks.
The RTA and LTB rules allow parties to represent themselves at hearings. Many tenants and landlords do so successfully, especially with resources like Tribunals Ontario’s Navigate Tribunals Ontario tool or legal clinics.
Tenants have “security of tenancy” under the RTA, meaning they can remain in the rental unit until the LTB issues an eviction order and the Sheriff enforces it. A landlord serving a notice to end tenancy (e.g., N4, N12) does not require the tenant to move out immediately. If the tenant disputes the notice or stays, the landlord must apply to the LTB, and the tenant can remain during the process until a final order is issued.
Under the RTA, rent increases for most residential units are capped at the annual guideline set by the Ontario government (e.g., 2.5% for 2025). Landlords cannot exceed this without LTB approval for an Above Guideline Increase (AGI), which may be granted for extraordinary costs like major repairs, renovations, or property tax increases.
