The words with initial capital letters have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of these Terms and Conditions:

Acknowledgment

These Terms and Conditions govern the use of this Service and represent the agreement between you and Just Cause Advocacy. These Terms set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms and Conditions. If you disagree with any part of these Terms, you may not access the Service.

You represent that you are over the age of 18. Just Cause Advocacy does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on your acceptance of and compliance with the Privacy Policy of Just Cause Advocacy. The Privacy Policy describes policies and procedures regarding the collection, use, and disclosure of your personal information when you use the website and outlines your privacy rights and how the law protects you. Please read the Privacy Policy carefully before using the Service.

Links to Other Websites

The Service may contain links to third-party websites or services not owned or controlled by Just Cause Advocacy.

Just Cause Advocacy has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Just Cause Advocacy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through such websites or services.

You are strongly advised to read the terms and conditions and privacy policies of any third-party websites or services you visit.

Termination

Just Cause Advocacy may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms and Conditions.

Upon termination, your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages you might incur, the entire liability of Just Cause Advocacy and any of its suppliers under any provision of these Terms—and your exclusive remedy for all of the foregoing—shall be limited to the amount actually paid by you through the Service or 100 USD if you haven’t purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall Just Cause Advocacy or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, loss of profits, data, business interruption, personal injury, or loss of privacy), even if advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so some of these limitations may not apply to you. In such cases, liability will be limited to the greatest extent permitted by law.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE,” with all faults and defects, without warranty of any kind. To the maximum extent permitted by applicable law, Just Cause Advocacy, on its own behalf and on behalf of its affiliates, licensors, and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limitation, Just Cause Advocacy makes no representation or warranty that:

  1. The Service will meet your requirements.

  2. The Service will operate uninterrupted or error-free.

  3. The information provided is accurate, reliable, or current.

  4. The Service, its servers, or communications sent are free of viruses or harmful components.

Some jurisdictions do not allow certain exclusions or limitations, so these may not apply to you.

Governing Law

The laws of Ontario, Canada, excluding its conflict of law rules, govern these Terms and your use of the Service. Your use of the website may also be subject to other local, national, or international laws.

Dispute Resolution

If you have any concern or dispute about the Service, you agree to first attempt to resolve the dispute informally by contacting Just Cause Advocacy.

For European Union (EU) Users

If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you reside.

United States Legal Compliance

You represent and warrant that:
(i) You are not located in a country that is subject to a United States government embargo or has been designated as a “terrorist supporting” country; and
(ii) You are not listed on any U.S. government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be interpreted to accomplish its purpose to the greatest extent possible, and the remaining provisions shall continue in full force and effect.

Waiver

Failure to exercise a right or enforce an obligation under these Terms shall not constitute a waiver of that right or obligation. A waiver of one breach does not waive any subsequent breaches.

Translation Interpretation

These Terms and Conditions may have been translated if made available in multiple languages. The original English version shall prevail in case of a dispute.

Changes to These Terms and Conditions

Just Cause Advocacy reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, reasonable efforts will be made to provide at least 30 days’ notice prior to the new terms taking effect. What constitutes a material change will be determined at Just Cause Advocacy’s discretion.

By continuing to access or use the Service after revisions take effect, you agree to be bound by the updated Terms. If you do not agree to the new Terms, you must stop using the website and the Service.
